Ex-Waco police officer arrested again after woman alleges he touched her 5-year-old son: affidavit

WACO, Texas (KWTX) - A former Waco police officer was arrested again on Dec. 30, 2025, after police learned of allegations he touched a 5-year-old boy inappropriately, an arrest warrant states.

Heath Mynar, 54, was charged with indecency with a child, a third-degree felony. He remains jailed at the McLennan County Jail on a $100,000 bond, according to online jail records.

The mother of the boy came forward after reading a report on KWTX.com about Mynar’s arrest on a charge of aggravated sexual assault of a minor on Nov. 10, 2025.

In that case, the parents of a 6-year-old girl claimed Mynar touched her improperly on Oct. 4, 2025, while on a walk and on her grandmother’s front porch.

LATEST CASE ALLEGEDLY INVOLVING BOY

The incident involving the 6-year-old boy allegedly happened on Nov. 23, 2023, in a residence in the 1000 block of 66th Street in Waco. The mother filed a police report on Nov. 12, 2025.

According to the mother, a family friend witnessed Mynar touching the boy during a Thanksgiving dinner. Detectives interviewed the witness, who said they observed Mynar rubbing the boy’s back and then reach under the boy’s clothing to touch the child’s buttocks, an arrest warrant states.

The witness said the boy jumped and looked around when Mynar touched him, per the arrest warrant. The witness called out the boy’s name and Myner immediately removed his hand from the child’s backside, the document further states.

According to police, the mother of the child was notified and confronted Mynar, “who did not deny touching the the victim and attempted to redirect the conversation to other topics.”

The mother told police she delayed reporting the incident to police because Mynar was a former police office and because she believed she did not have enough information to proceed.

“After seeing [Mynar’s] recent arrest on [KWTX], the mother decided to come forward and report the incident,” police wrote in the warrant.

MYNAR’S RETIREMENT FROM WACO POLICE DEPARMENT

Mynar retired from the Waco Police Department after his arrest on assault-family violence by occlusion charges in a November 2019 incident involving his former girlfriend at a South Waco apartment.

He initially was arrested on a misdemeanor family violence charge. However, he was indicted on an upgraded third-degree felony count after the woman reported Mynar restricted her breathing.

Court records show the McLennan County District Attorney’s Office dismissed that charge in April 2023 after Mynar completed a pretrial intervention program known as PTIP. The program is designed for first-time or low-risk offenders who can avoid criminal convictions if they admit their guilt and complete programs similar to those on probation.
