‘My clients feel more safe’: Lawyer for alleged victims of Fort Hood doctor speaks after doctor’s arrest

KILLEEN, Texas (KWTX) - According to a press release from Army Criminal Investigative Division, Dr. Blain McGraw was taken into custody on October 17th but at some point released to his chain of command.

He has been taken back into custody and is currently in the Bell County Jail as a U.S. Army inmate.

According to the Cobos Law Firm, that represents 70 alleged victims, Dr. McGraw had been released to his chain of command with several restrictions.

“He was released to his chain of command, and he was confined to the barracks but that he had some privileges,” said Andrew Cobos with the Cobos Law Firm. “Meaning, that he had to check in every 2 hours.”

According a press release from Fort Hood, Dr. McGraw is being held on pretrial confinement.

“Fort Hood officials ordered Maj. Blaine McGraw into pretrial confinement on Dec. 2, and he is currently being held in the Bell County Jail, Texas, after apparently violating conditions of liberty imposed by his commander,” Fort Hood officials said in the press release.

“He was under orders to act in a specific way, and he had certain prohibitions put on him and he violated that,” said Cobos. “He demonstrated the Army and really to the survivors, that this is another reason why he can’t be trusted.”

Cobos said he believes McGraw will remain there until hearing is to decide if he will remain in jail until his trial.

“Whether or not that is a temporary thing, whether or not it lasts up until the point of the trial, is something the courts are going to have to decide,” said Cobos.

It’s something that is confirmed in the press release that states, “In accordance with the Uniform Code of Military Justice, a neutral and detached military magistrate will conduct a pretrial confinement review within seven days, and the magistrate will determine whether continued confinement is warranted.”

Cobos said his clients have told him they feel safer with McGraw behind bars.

“It makes my clients feel a lot more comfortable, know that the individual that sexually assaulted them is not going to be running into them at the local Walmart,” said Cobos. “That was a concern they had and a valid concern that needed to be addressed.”

It is important to note that KWTX has not seen formal charges filed against Dr. McGraw at this time but the list of potential victims is growing.

Army CID said they are working to make sure the investigation is as thorough as possible.
