Waco woman alleging sexual harassment while working at Kohl’s seeking $1 million in damages

WACO, Texas (KWTX) - A McLennan County woman who claims she was sexually harassed and assaulted while working at the Waco Kohl’s is seeking more than $1 million in a lawsuit against the company and a former employee.

The woman, identified in her lawsuit as “Jane Doe,” claims sexual harassment, sexual assault, retaliation and intentional infliction of emotional distress in her suit filed last week in Waco’s 74th State District Court. The lawsuit names Kohl’s Inc. and Scott Green, a former loss prevention specialist at the department store.

An assistant manager at the Kohl’s store in Waco declined comment Wednesday and referred questions about the lawsuit to Kohl’s corporate human resources. She also declined to say if Green is still employed there.

However, another store employee said Green no longer works there.

Green did not return a message left Wednesday with his current employer. There was no response to messages left at Kohl’s corporate office in Menomonee Falls, Wisconsin.

Doe, who is represented by Waco attorney Ryan Johnson, started working at Kohl’s in July 2024 and worked there about a year. Green, according to the lawsuit, had a “well-known history of erratic and concerning behavior which should have been huge red flags for Kohl’s.”

“Nonetheless, Kohl’s hired Green and placed Green in a position of power and access, despite his public record,” the lawsuit alleges. “Unsurprisingly, Green used his position at Kohl’s to sexually harass and assault one or more women at Kohl’s Department Store in Waco, Texas.”

The lawsuit claims that within the first few weeks of Doe being hired, Green began “consistently and repeatedly” sexually harassing her.

“Green’s harassment was so overt and obvious that Kohl’s management was aware of harassment, but refused to address or remedy the issue,” the suit states.

Doe reported the harassment and assault to management, other employees and “ultimately the authorities, the lawsuit contends.“Yet Kohl’s continued to ignore plaintiff’s reports. Defendant Green’s sexual harassment and assault of Plaintiff was so pervasive that it prevented Plaintiff from being able to work safely at Kohl’s. Yet, Kohl’s did nothing,” according to the lawsuit.

Doe filed a complaint in August 2025 with the Texas Workforce Commission and was given notice of her right to sue by the U.S. Equal Employment Opportunity Commission on Aug. 27, 2025.

The lawsuit claims Doe repeatedly told Green “to stop sexually harassing her and physically touching her in a sexually inappropriate manner.”

“Ultimately, one or more of the Kohl’s Defendants’ retaliatory conduct led to Plaintiff’s actual discharge of employment from Kohl’s,” the suit claims.
