‘I’m gonna shoot this b****’: Waco woman threatened judge during truancy hearing, affidavit states

WACO, Texas (KWTX) - A Waco woman was arrested Thursday after authorities say she threatened to shoot a judge during a truancy hearing in South Waco.

According to arrest records, Hernandez and several of her family members were in Precinct 5 Justice of the Peace Court, 1800 Richter Ave., Thursday afternoon when Judge LucyAnn Sanchez-Miramontez asked Hernandez’s mother why her children were not going to school.

While Hernandez’s mother was speaking, Hernandez’s 15-year-old brother “caught the attention of the judge by smiling visibly and silently laughing,” an arrest affidavit states. The judge paused the truancy hearing and told him to stop laughing or leave the courtroom.

“(He) didn’t stop. Judge told the defendants that she will be taking care of this by sending their mother to jail for 6 days due to ignoring a court order for truancy,” the affidavit alleges. “Daisy stated aloud to the Judge, ‘You can’t do that.’ Judge responded, ‘Yes I can.’”

Hernandez continued “to yell” at the judge, and Sanchez-Miramontez broke her gavel pounding it on the podium, according to the affidavit.

The judge ordered deputies to remove Hernandez and her brother from the courtroom. As she was being escorted from court, Hernandez shouted, “I’m gonna shoot this bitch,” arrest documents allege.

The judge asked, “Did she say that?”

Several witnesses in the courtroom provided statements about the incident, the affidavit states.

“When things calmed down, I asked Daisy why she told the judge she was gonna shoot her,” a deputy constable wrote in the affidavit. “Daisy stated, ‘I don’t know. I was mad.’”

Sanchez-Miramontez said Friday that Hernandez’s mother was in court on allegations she failed to comply with previous orders regarding truancy. She said the woman provided documentation on Thursday that her children were attending school and she allowed her to leave.

“I give families every opportunity and offer them every community resource to comply with court orders,” the judge said Friday.

State jail felonies are punishable by up to two years in a state jail facility.
